Terms and Conditions of Sale (TCS)

1. Subject and Identification of the Seller

These General Conditions govern the purchase of products made remotely through the site Acme Speedworks. The seller is Acme Speedworks S.r.l., with registered office in Castelnuovo del Garda, VAT IT05136340238, email: info@acmespeedworks.com, (hereinafter "Seller").

2. Conclusion of the Contract

The order sent by the Customer constitutes a contractual proposal. The contract is deemed concluded only when the Seller sends theOrder Confirmationvia email. The Seller reserves the right not to accept orders in case of unavailability of products or technical errors in the price list.

3. Prices and Payments

  • Prices:All prices are expressed inEurosand include VAT (if applicable). Shipping costs are clearly highlighted before the purchase confirmation.

  • Errors:In the event of a glaring error in the price (e.g. an item priced at €500 indicated at €5), the Seller reserves the right to cancel the order and fully refund the Customer.

  • Methods:Credit Card, PayPal and Bank Transfer are accepted. In the case of a bank transfer, the order will be processed only after the actual crediting.

4. Shipping and Delivery

  • Terms: The Seller undertakes to deliver the goods within 30 days from the date of conclusion of the contract (legal term). The times indicated on the site are estimated.

  • Risk: According to Article 63 of the Consumer Code, the risk of loss or damage to the goods is transferred to the Customer only at the moment when the latter (or a designated third party) physically takes possession of the goods.

5. Right of Withdrawal (For Consumers Only)

The Customer (a natural person purchasing for purposes unrelated to their professional activity) has the right to withdraw from the contract, without providing reasons, within 14 days from the receipt of the products.

  • Methods: The withdrawal must be communicated via email or through a specific form.

  • Returns: The Customer must return the goods intact and in their original packaging. The shipping costs for the return are the responsibility of the Customer, as provided by law, unless otherwise indicated by the Seller.

  • Refund: The Seller will refund all payments received within 14 days from the communication of withdrawal, subject to receipt and verification of the goods.

5.1 Exceptions to the right of withdrawal:According to Article 59, letter c) of the Consumer Code, the right of withdrawal isexcludedfor the supply of goods made to measure or clearly personalised, as well as for productsspecifically ordered at the Customer's request("made-to-order" products) that do not form part of the Seller's usual stock. In such cases, once the order is confirmed, it will not be possible to cancel it or return the goods for reconsideration.

6. Legal Warranty of Conformity

  • Consumers (B2C):The legal warranty of 24 monthsapplies for conformity defects. The Customer must report the defect within 2 monthsof discovery.

  • Professionals (B2B):If the purchase is made with VAT, the warranty is for 12 monthsand the defect must be reported within 8 days.

  • For high-performance or competition components, the warranty does not cover damages resulting from incorrect installation, improper use, or competitive events, unless expressly provided.

7. Liability and Products for Competition Use

Many products sold by Acme Speedworks may be intended solely for competitive/sporting use on closed circuits. It is the Customer's responsibility to ensure that the installation of such components complies with the Road Code of their country. The Seller disclaims all liability for improper or non-homologated use.

8. Applicable Law and Competent Court

  • Law:The contract is governed by Italian Law.

  • Consumer Court: For disputes with a Consumer, the competent court is unconditionally that ofthe Customer's residence or domicile, if located in Italy.

  • Business Court: For purchases with VAT, the exclusive court will be that of [Your Court, e.g. Verona].

  • ODR: The consumer is informed that the European platform for online dispute resolution (Online Dispute Resolution) is available at the following link:https://ec.europa.eu/consumers/odr/.

9. Rental Services and Track Use

The purchase of vehicle rental services or equipment for use on the track (track days) involves acceptance of the following points:

  • Assumption of Risk: The Customer acknowledges that driving on the track is an inherently dangerous activity. By participating, the Customer assumes exclusive responsibility for any damage caused to themselves, third parties, the rented vehicle, or the track facilities.

  • Disclaimer of Liability: Acme Speedworks S.r.l. cannot be held responsible for personal injury, death, or property damage resulting from accidents, mechanical failures due to extreme stresses, or driving errors during the rental service.

  • Damage to the Vehicle: In the event of damage to the rented vehicle caused by collisions, going off track, or negligence, the Customer is required to fully compensate the restoration costs, subject to any deductibles or optional insurance cover taken out separately and specified in the specific rental contract.

  • Conduct Obligation: The Customer agrees to strictly adhere to the circuit regulations and the instructions provided by Acme Speedworks staff. The staff reserves the right to terminate the service at any time, without the right to a refund, should the Customer engage in dangerous conduct.
